  no sparing sasuke was a ploy. he didnt have to bring himself to not kill or to kill. it was not on the agenda. itachi is a double agent for the 3rd hokage. bigger things occured that night he killed the uchihas. involving shisui, fake madara, sarutobi, danzo. sasuki was a set up by itachi, to get itachi’s power, due to itachi’s illness. and his need to counter madara. tobi’s mask keeps itachi’s eyes from attacking him, with the trap in the eternal sharigan eyes.
